For that reason, those who administer the public funds ought to be more concerned about meeting the needs of the Prophet’s household—on whom charity is forbidden—than they are about meeting the needs of others through the obligatory charity, especially when the family is unable to receive its allotted share from the one-fifth or from the fay. This may occur either because those funds are insufficient or because unjust rulers seize their rights and withhold them. In such cases, they must be given from the obligatory charity whatever will suffice them, since their needs have not been met through the one-fifth and the fay.
(1) The hadith is reported by Ahmad b. Hanbal in the Musnad 2:50–92 and by al-Bukhari in the Sahih, Book of Jihad, ch. 88 (as a muʿallaq report). Al-Suyuti cites it in al-Jamiʿ al-saghir, no. 3152, attributing it to Ahmad, al-Tabarani, and ʿAbd al-Razzaq on the authority of Ibn ʿUmar. Al-Manawi, in his commentary on al-Jamiʿ al-saghir, traces it to Ibn Abi Shaybah, ʿAbd b. Humayd, and al-Bayhaqi in Shuʿab al-iman. Al-Haythami also includes it in Majmaʿ al-zawaʾid.
