Concerning the time for the ‘Isha prayer, he says: “The span in which it is permissible—and in cases of necessity obligatory—to perform ‘Isha lasts until dawn, based on the hadith of Abu Qatadah in which the Messenger of Allah ﷺ said: ‘There is no negligence in sleep; negligence lies only with the one who does not perform the prayer until the time of the next prayer arrives.’ ” Muslim recorded this report.
They infer from the hadith that the time for every prayer remains valid until the next prayer begins, except for Fajr, whose time does not stretch to Zuhr, for the scholars unanimously agree that it ends with sunrise.
I say: The author, following al-Shawkani and others, has used this hadith as evidence, yet it provides no proof for the position they advance, since it neither lays out the prayer times nor was it transmitted for that purpose.
