Ḥabīb in transmitting from ʿAmr ibn al-Walīd. Moreover, this isnād indicates a gap between it and the earlier report he related from ʿAbd Allāh ibn ʿAmr in the first route of the fourth ḥadith.
However, I found the same narration of Qays recorded by ʿAbd al-Raḥmān ibn ʿAbd Allāh ibn ʿAbd al-Ḥakam in Futūḥ Miṣr, p. 273. He transmitted it from Ibn Luhayʿah, from Yazīd ibn Abī Ḥabīb, from ʿAmr ibn al-Walīd ibn ʿAbdah, from Qays ibn Saʿd, that the Messenger of Allah ﷺ came out to them … the ḥadith. He said, “My father, ʿAbd Allāh ibn ʿAbd al-Ḥakam, related it to me,” and he may have inserted between ʿAmr ibn al-Walīd and Qays the remark, “It reached him.”
I say: Muḥammad ibn ʿAbd Allāh ibn ʿAbd al-Ḥakam differs here from his brother ʿAbd al-Raḥmān ibn ʿAbd Allāh ibn ʿAbd al-Ḥakam. Both are truthful, but the former is the more prominent. Muḥammad placed the break between ʿAmr ibn al-Walīd and ʿAbd Allāh ibn ʿAmr, while his brother located it between ʿAmr ibn al-Walīd and Qays ibn ʿUbādah. The first view is preferable, for Muḥammad paired Ibn Luhayʿah with al-Layth ibn Saʿd—a reliable ḥāfiẓ—whereas his brother mentioned only Ibn Luhayʿah, whose weakness is well known. Allah knows best.
The ḥadith has yet another route, reported by ʿUbayd Allāh ibn Zahr from Bakr ibn Sawādah, from Qays ibn Saʿd, traced back to the Prophet with the wording:
“Indeed, my Lord—Blessed and Exalted be He—has forbidden for me wine, the kūbah (drum), and the qanīn (lute); and beware of al-ghubayrāʾ, for it is a third of the world’s wine.”
It was recorded by Ibn Abī Shaybah in al-Muṣannaf 8/197/4132, by al-Bayhaqī, by Aḥmad 3/422, in al-Ashribah 27, and by Ibn ʿAbd al-Ḥakam in Futūḥ
