The ḥadith master and musnid Abū al-Ḥusayn Muḥammad ibn Aḥmad ibn Muḥammad ibn ʿAlī al-Aswārī al-Iṣfahānī also passed away, as did the leading shaykh of the hadith scholars and ascetics in Nishapur, Abū Bakr Muḥammad ibn Dāwūd ibn Sulaymān al-Naysābūrī.
I read to Abū al-Maʿālī Aḥmad ibn al-Muʾayyad, who reported to us: Muḥammad ibn Muḥammad al-Maʾmūnī reported to us; Aḥmad ibn Muḥammad, the ḥāfiẓ, reported to us; al-Qāsim ibn al-Faḍl narrated to us; Muḥammad ibn Ibrāhīm ibn Jaʿfar al-Yazdī dictated to us, saying: Abū Bakr Aḥmad ibn Isḥāq ibn Ayyūb al-Ṣibghī informed us; Muḥammad ibn Ghālib ibn Ḥarb narrated to us; Dāwūd ibn ʿAbd Allāh al-Jaʿfarī narrated to us; Mālik narrated from Nāfiʿ, from Ibn ʿUmar, that the Messenger of Allah ﷺ used to raise his hands when he pronounced the opening takbīr and when he rose from bowing. (1)
With this same chain: al-Ṣibghī informed us; Aḥmad ibn al-Qāsim ibn Abī Musāwir narrated to us; Abū Maʿmar Ismāʿīl ibn Ibrāhīm narrated to us, saying: ʿAlī ibn Wahb dictated to me from memory, from Yūnus, from al-Zuhrī, from Anas, that the Prophet ﷺ said: “No amputation is to be carried out against a highway robber, a purse-snatcher, or a treacherous thief.” (2)
(1) Its chain of transmission is sound. The hadith appears in al-Muwattaʾ 1/77; through Malik’s route it is also recorded by Abu Dawud (742). Via the isnad Ibn Shihab – Salim – ʿAbd Allah b. ʿUmar it is cited by Malik 1/75, al-Bukhari 2/181 (Book on the Description of Prayer), and Muslim (390).
(2) Ahmad 3/380, al-Darimi 2/175, Abu Dawud (4393), al-Nasai 8/89, al-Tirmidhi (1448), Ibn Majah (2591), al-Tahawi 2/98, al-Daraqutni 3/187, and al-Bayhaqi 8/279 all report the hadith through the chain Ibn Jurayj – Abu al-Zubayr – Jabir b. ʿAbd Allah. The isnad is sound: Ibn Jurayj explicitly stated that he heard it from Abu al-Zubayr in al-Darimi and elsewhere. He is corroborated by Sufyan al-Thawri and al-Mughira b. Muslim. Nor is Abu al-Zubayr alone in transmitting it, for ʿAmr b. Dinar supports him in Ibn Hibban, and Abu al-Zubayr himself affirmed direct hearing from Jabir in the version of ʿAbd al-Razzaq, removing any suspicion of tadlis. Al-Tirmidhi graded the hadith “hasan sahih,” and Ibn Hibban authenticated it (nos. 1502, 1503). Al-Zaylaʿi notes in Nasb al-rayah 3/364 that ʿAbd al-Haqq in his Ahkam and Ibn al-Qattan remained silent about it, which implies they deemed it sound. See also Sharh al-sunnah 10/321–322.
