from his father, from Abū Hurayrah:
that the Prophet (peace and blessings be upon him) ruled that an oath together with a single witness is sufficient.
ʿAbd al-ʿAzīz said: I mentioned this to Suhayl, and he replied, “Rabiʿah—whom I deem trustworthy—told me that I had narrated it to him, but I no longer remember it.”
ʿAbd al-ʿAzīz added: Suhayl had been stricken by an illness that impaired part of his memory and caused him to forget some of his narrations, so thereafter Suhayl would relate it through Rabiʿah on his own authority.
It was recorded by Abū Dāwūd (1) through the transmission of al-Rabiʿ.
Among his contemporaries is the reliable imam and ḥadith scholar,
223 – Abū Muḥammad al-Rabiʿ ibn Sulaymān al-Azdi* (Abū Dāwūd, al-Nasāʾī): their client, the Egyptian from Giza, nicknamed “the Lame.”
He heard ḥadith from Ibn Wahb and also from al-Shāfiʿī.
Those who narrated from him include Abū Dāwūd, al-Nasāʾī, al-Ṭaḥāwī, and others.
(1) No. 3610, in the section “Judgments: Chapter on ruling on the basis of an oath and a single witness.” It is likewise reported by al-Shafi‘i (no. 1406); al-Tirmidhi (no. 1343) in “Legal Rulings: Chapter on the oath together with a witness”; Ibn Majah (no. 2368); and al-Tahawi, 4 / 144, all through the chain of transmission of ‘Abd al-‘Aziz ibn Muhammad. The transmitters in this chain are reliable according to Muslim’s criteria. Al-Tirmidhi judged the hadith “hasan gharib.”
It is supported by a report from Ibn ‘Abbas recorded by Muslim (no. 1712), Abu Dawud (no. 3608), Ibn al-Jarud (no. 1006), Ahmad 1 / 248, 315, 323, Ibn Majah (no. 2370), al-Tahawi 4 / 144, al-Shafi‘i (no. 1402), and al-Bayhaqi 10 / 167; and by a report from Jabir ibn ‘Abd Allah preserved by al-Tirmidhi (no. 1344), Ibn Majah (no. 2369), Ahmad 3 / 305, Ibn al-Jarud (no. 1008), and al-Bayhaqi 10 / 170. Malik also transmits it (2 / 721), while al-Shafi‘i (no. 1407) gives it in mursal form, which is the sounder version. A further narration comes from Sarq in Ibn Majah (no. 2371) and al-Bayhaqi 10 / 172–173; one of its transmitters is unnamed, while the rest are trustworthy.
