- Abū ʿAbd al-Raḥmān al-Shāfiʿī *
A dialectical theologian of exceptional intellect and one of the eminent pupils of Imām Abū ʿAbd Allāh al-Shāfiʿī. His given name was Aḥmad ibn Yaḥyā ibn ʿAbd al-ʿAzīz, but he was identified by reference to his teacher.
Al-Ḥāfiẓ Abū Bakr relates that he would say:
“Whoever deliberately lets a prayer lapse beyond its appointed time can never make it up at all, because the time is a prerequisite and it has passed—just as one who misses the standing at ʿArafāt cannot make that up.” ⦗1⦘
I (the author) say: The vast majority of the umma hold that the prayer must still be performed, and that doing so does not remove the sin unless accompanied by repentance.
The jurist Dāwūd al-Ẓāhirī and others studied under Abū ʿAbd al-Raḥmān al-Shāfiʿī. He was alive until roughly the early 230s AH.
Among the leading Muʿtazilites of Baghdad was the scholar Abū Mūsā al-Farrāʾ; al-Masʿūdī records his death in 226 AH.

(1) A number of early and later scholars have taken this view, maintaining that sincere repentance (*tawba nasuh*) is sufficient. Al-Asnawi notes in al-Tamhid, pp. 245–246, that Shaykh Izz al-Din ibn Abd al-Salam in al-Qawaid, al-Taj al-Farkah in his Sharh al-Tanbih, and a position transmitted within the school from Ibn Bint al-Shafi‘i, all hold that one who deliberately omits the prayer is not obliged to make it up (*qada*). Al-Asnawi adds that he found the same opinion in the chapter on the prostration of forgetfulness in Ibn al-Ustadh’s commentary on al-Wasit, citing it from Ibn Kajj’s at-Tajrid. Ibn al-Qayyim has examined the issue exhaustively, setting out the arguments of both sides—the majority who require *qada* and those who do not—in his book al-Salat, pp. 59–98; consult it, for it is of great value.
