than that he should speak and be branded a zindīq (heretic). Nothing is more loathsome to me than kalām (speculative theology) and its proponents(1).
I say: This demonstrates that Abū ʿAbd Allah’s position is that a mistake in the fundamentals is not like a mistake made through ijtihād in subsidiary rulings.
Al-Rabīʿ ibn Sulaymān said: I heard al-Shāfiʿī state, “Whoever swears by one of the Names of Allah and then breaks his oath is required to make expiation, because the Name of Allah is uncreated. But whoever swears by the Kaʿba, or by Ṣafā and Marwa, incurs no expiation, for they are created, whereas His Name is uncreated.”
(1) Ibn ʿAsakir, Tarikh, 4/405/1. Al-Bayhaqi relates in Manaqib, 1/453–454, from Yunus b. ʿAbd al-Aʿla: “I visited al-Shafiʿi after he had spoken with Hafs al-Fard. He said, ‘You have been absent from us, Abu Musa. I have just witnessed something among the practitioners of kalam (speculative theology) that, by Allah, I never imagined possible. For a man to be tried with every sin forbidden by God—except associating partners with Him—is better than for God to test him with kalam.’”
Al-Bayhaqi comments: “By these words al-Shafiʿi—may Allah bless him—meant Hafs and those like him among the innovators. This is what he intended in everything reported from him deprecating kalam and its partisans. Some transmitters left the statement absolute, others qualified it; the qualified wording clarifies his intent.”
He then cites Abu al-Walid b. al-Jarud: “Hafs al-Fard entered upon al-Shafiʿi and debated him. When he left, al-Shafiʿi came out to us and said, ‘For a servant to meet Allah laden with sins as high as the mountains of Tihama is better for him than to meet Him believing a single doctrine held by this man and his companions’—for Hafs affirmed the creation of the Quran.”
Al-Bayhaqi concludes: “These reports make clear what al-Shafiʿi meant in the statements already cited and in others not recorded here. How could the discourse of Ahl al-Sunnah wa-l-Jamaʿa be reprehensible to him when he himself engaged in it, debated its opponents, and exposed the sophistry that some followers of passion had whispered to a few of his students?”

Al-Bayhaqi remarks: “Thus an oath taken by one of God’s names is treated like an oath by Allah Himself.” He continues: “Whoever swears by something other than God incurs no expiation, which shows that it is incorrect to call God’s names and attributes ‘other-than-God’; the term ‘other’ applies only to created things.”
