ʿAbd al-Ḥāfiẓ ibn Badrān and Yūsuf ibn Aḥmad informed us, saying:

“That the Messenger of Allah ﷺ granted a concession regarding the ʿarāyā (1).”

ʿAbd al-Ḥāfiẓ ibn Badrān in Nablus informed us; Shaykh Muwaffaq al-Dīn ʿAbd Allāh ibn Aḥmad al-Maqdisī informed us in the year 615 AH; Muḥammad ibn ʿAbd al-Bāqī informed us, and ʿAbd al-Raḥmān ibn Muḥammad al-Faqīh together with other scholars wrote to me:
That the judge Abū al-Qāsim ʿAbd al-Ṣamad ibn Muḥammad al-Anṣārī informed them in the year 610 AH. He said:
Abū al-Fatḥ Naṣr Allāh ibn Muḥammad informed us, who said:
Abū al-Ḥasan ʿAlī ibn Muḥammad ibn Muḥammad al-Anbārī informed us; Abū Aḥmad ʿUbayd Allāh ibn Muḥammad ibn Abī Muslim al-Faraḍī narrated to us; Abū Bakr Yūsuf ibn Yaʿqūb al-Kātib narrated to us; Bishr ibn Maṭar narrated to us; Sufyān reported from Ibn Abī Najīḥ, from Ibrāhīm ibn Abī Bakr, from Mujāhid concerning Allah’s words, “Allah does not like the public mention of evil speech except by one who has been wronged …” (al-Nisāʾ 4:148). He said:
“That is with regard to hospitality: if you come …”

Al-Nihaya explains that it denotes a needy person who owns no palm-trees: the harvest of fresh dates is at hand, yet he has neither cash to purchase them nor trees from which to feed his family. What he does possess is a surplus of dried dates. He therefore approaches a palm-grove owner and says, “Sell me the produce of one or two palm-trees for its estimated equivalent in dried dates.” The owner accepts the dried dates in exchange for the fresh yield of those trees, enabling the poor man to enjoy fresh dates like others. This concession is allowed so long as the quantity involved is less than five wasqs (about 612 kg). The term ʿariyya follows the morphological pattern faʿiliyya with the sense of a passive participle (mafʿula) derived from ʿaraa yaʿruhu (“to approach”); it may also be understood on the pattern faʿila from ʿariya yaʿra (“to strip off a garment”), as though this type of sale has been “stripped out” from the general prohibition and thus exempted.
