Siyar Aʿlām al-NubalāʾShams al‑Din al‑Dhahabi

Abū al-Maʿālī Aḥmad ibn Isḥāq in Egypt informed us; Abū al-Maḥāsin Muḥammad ibn Hibat Allāh ibn ʿAbd al-ʿAzīz al-Dīnawarī in Baghdad informed us; my uncle Muḥammad ibn ʿAbd al-ʿAzīz informed us in the year 539 AH; ʿĀṣim ibn al-Ḥasan informed us; Abū ʿUmar ibn Mahdī informed us; al-Ḥusayn ibn Ismāʿīl al-Maḥāmilī dictated to us; Abū Mūsā Muḥammad ibn al-Muthannā related to us; Ibn ʿUyaynah related from Hishām ibn ʿUrwah, from his father, from ʿĀʾishah:
“When the Prophet ﷺ came to Mecca, he entered from its upper side and left from its lower side.”
It was recorded by the Two Shaykhs, Abū Dāwūd, al-Tirmidhī, and al-Nasāʾī (1).

Aḥmad ibn Isḥāq al-Miṣrī informed us; likewise Aḥmad ibn Yūsuf and al-Fath ibn ʿAbd al-Salām, who said: Muḥammad ibn ʿUmar the judge informed us; Abū al-Ḥusayn Aḥmad ibn Muḥammad al-Bazzāz informed us; ʿAlī ibn al-Sukkarī informed us; Aḥmad ibn al-Ḥasan ibn ʿAbd al-Jabbār al-Ṣūfī informed us in the year 303 AH; Yaḥyā ibn Maʿīn related to us; Ibn ʿUyaynah related from Ḥumayd al-Aʿraj, from Sulaymān ibn ʿAtīq, from Jābir ibn ʿAbd Allāh:
“The Prophet ﷺ ordered that losses caused by blight (al-jawāʾiḥ) be waived and forbade selling produce for future years.”
Abū Dāwūd recorded it (2) through Yaḥyā.

(1) Reported by al-Bukhari, 3/347: Book of Pilgrimage, chapter “From where one should depart when leaving Mecca,” and in the Book of Military Expeditions, chapter “The Prophet’s entry from the upper part of Mecca.” Also transmitted by Muslim (1258), Book of Pilgrimage, chapter “Recommendation to enter Mecca from the upper pass,” by al-Tirmidhi (853), and by Abu Dawud (1868–1869). (2) No. 3374 in the Book of Ijazah, chapters “Remission after a calamity” and “The sale for successive years”; its chain of transmission is sound. Muslim likewise records it (1554/17) through Ibn Uyaynah—Humayd al-Araj—Sulayman ibn Atiqah—from Jabir: the Prophet ordered the cancellation of fruit sales when calamities strike. Muslim also cites (1554/14) the wording narrated by Abu az-Zubayr, who heard Jabir ibn Abd Allah say that the Messenger of Allah declared: “If you sell dates to your brother and they are struck by a *jaihah* (a pest that destroys the crop), it is not lawful for you to take anything from him. Why would you seize your brother’s wealth unjustly?” The “sale of years” (*bay‘ al-sinin*) is the transaction in which a man sells the specific future produce of a tree for three, four, or more years.
