Muḥammad ibn Ḥarb al-Nashāʾī reported: Yazīd ibn Hārūn narrated to us; Shuʿbah informed us; from Faraj ibn Faḍālah; from Ismāʿīl ibn ʿAyyāsh; from Abū Bakr ibn Abī Maryam; from Ḥabīb; from ʿUbayd; from ʿAwf ibn Mālik — that the Prophet ﷺ “offered the funeral prayer …,” and the rest of the report follows. ⦗1⦘
Yazīd added, “Ismāʿīl later came to us, so we recounted it to him.”
Abū Zurʿah al-Dimashqī said, “After al-Awzāʿī and Saʿīd ibn ʿAbd al-ʿAzīz, no one in Syria had a better memory than Ismāʿīl ibn ʿAyyāsh.”
Ismāʿīl ibn ʿAyyāsh also transmitted—from Ibn Jurayj, from ʿAmr ibn Shuʿayb, from his father, from his grandfather—that the Prophet ﷺ said: “Overlook the prescribed penalties among yourselves; once a prescribed penalty reaches me, it must be enforced.” ⦗2⦘
Ismaʿil ibn ʿAyyash transmits from Sharhabil ibn Muslim, from Abu Umamah. The full wording is: “The borrowed object must be returned; the milk-loan is to be handed back; the debt must be paid; and the guarantor is liable.” The author’s statement that “this isnad is strong” is not accurate, because Sharhabil ibn Muslim al-Khawlani is disputed: Ahmad considered him reliable, whereas Ibn Maʿin judged him weak; hence Ibn Hajar says in al-Taqrib, “trustworthy, but somewhat lenient.” The matn, however, is sound thanks to a corroborating chain in Ahmad 5/293, narrated by Ibn al-Mubarak, from ʿAbd al-Rahman ibn Yazid ibn Jabir, from Saʿid ibn Abi Saʿid, from someone who heard the Prophet say: “Indeed, the borrowed object must be returned; the milk-loan is to be handed back; the debt must be paid; and the guarantor is liable.” This chain is sahih. The word al-zaʿim means “the surety”: whoever guarantees another’s debt is responsible for paying it.
(1) Its complete wording is: “I memorized part of his supplication while he was saying: ‘O Allah, forgive him, have mercy on him, grant him well-being and pardon him; honor his dwelling, widen his entrance; wash him with water, snow, and hail; cleanse him of sins as a white garment is cleansed of dirt; replace his home with a better home, his family with a better family, and his spouse with a better spouse; admit him into Paradise and protect him from the punishment of the grave or the punishment of the Fire.’ ” Reported by Muslim (963); Ahmad 6/23; and al-Bayhaqi 4/40 through Muʿawiyah ibn Salih—Habib ibn ʿUbayd—Jubayr ibn Nufayr—ʿAwf ibn Malik. Also narrated by Abu Dawud al-Tayalisi 1/164 through al-Faraj ibn Fadala—Abu Bakr ibn Maryam—Habib ibn ʿUbayd—ʿAwf ibn Malik, who said, “This hadith is transmitted from Habib ibn ʿUbayd,” and by Ibn Majah (1500) through al-Tayalisi—ʿIsmah ibn Rashid—Habib ibn ʿUbayd—ʿAwf ibn Malik.
(2) Also recorded by Abu Dawud (4376) in the section on hudud, “Chapter: Pardoning hudud offenses before they reach the authority.”
