Abū Nuʿaym said, “I would pass by Zufar, and he would call out, ‘Come, so that I may sift for you what you have heard.’
Abū ʿĀṣim al-Nabīl reported that Zufar said, ‘Whoever takes his seat before its proper time is disgraced.’
Abū Nuʿaym also said, “I used to present ḥadiths to Zufar, and he would say: ‘This one abrogates, that one is abrogated; this is to be acted upon, that is to be rejected.’ ”
I say: This Imām was fair-minded in his inquiry and strictly followed the textual evidence.
ʿAbd al-Raḥmān ibn Mahdī said: ʿAbd al-Wāḥid ibn Ziyād narrated to us, saying,
“I met Zufar, may Allah have mercy on him, and remarked, ‘You have become a topic of conversation among the people and the object of their laughter (1).’
He asked, ‘And what is that?’
I replied, ‘You say, “Ward off the prescribed punishments through doubts (2),” yet…’
(1) al-dahika (with ḍ pronounced with u-damma and ḥ in sukun) refers to anything that provokes laughter.
(2) The injunction “Ward off the hudud (prescribed penalties) whenever you can” is reported through several chains:
• From Aisha: al-Tirmidhi, Sunan, ḥudud, no. 1424, with the wording, “Ward off the hudud from the Muslims as far as you can; if there is a way out for the accused, release him, for the imam’s error in pardoning is better than his error in punishment.” Al-Tirmidhi notes that the ḥadith is only known in marfuʿ form through Muhammad b. Rabiʿa → Yazid b. Ziyad al-Dimashqi → al-Zuhri, and that Yazid b. Ziyad is weak. Wakiʿ related it from Yazid without raising it to the Prophet, which is the sounder version; al-Tirmidhi therefore also records it as mawquf. Al-Hakim, Mustadrak, 4/384, judged the isnad sound, but al-Dhahabi objected, pointing out that Yazid b. Ziyad was declared “abandoned” (matruk) by al-Nasaʾi.
• From Ali: al-Daraqutni, p. 324; the chain contains Mukhtar al-Tammar, who is weak.
• From Abu Hurayra: Ibn Majah, no. 2545, and Abu Yaʿla, via Wakiʿ → Ibrahim b. al-Fadl al-Makhzumi → Saʿid al-Maqburi → Abu Hurayra. Ibrahim b. al-Fadl was judged weak by Ahmad, Ibn Maʿin, al-Bukhari, and others.
Additional narrations: Ibn ʿAdi—in a separate fascicle—from Ibn ʿAbbas, marfuʿ: “Ward off the hudud in cases of doubt, and overlook the slips of the noble—except in a hadd of Allah,” the chain containing Ibn Lahiʿa. The first part of the saying was also transmitted by Abu Muslim al-Kajji and Ibn al-Samʿani (al-Dhail) as a mursal report from ʿUmar b. ʿAbd al-ʿAziz, and by Musaddad in his Musnad as a mawquf statement of Ibn Masʿud.
