Abu Mushir said, “Saʿīd ibn ʿAbd al-ʿAzīz narrated to us; he related that Sulaymān ibn Mūsā read to them from a written scroll he had memorised, and that pleased him.”
Makhḥūl said to him, “Are you amazed? By Allah, I have never heard anything and placed it in my breast except that I could retrieve it whenever I wished.”
ʿAbbās ibn Muḥammad recalled: “I asked Yaḥyā about the report, ‘There is no marriage without a guardian (1).’ Does Ibn Jurayj transmit it?”
He replied, “Nothing on this topic is sound except the ḥadīth of Sulaymān ibn Mūsā.”
Aḥmad ibn Abī Yaḥyā said, “I heard Aḥmad ibn Ḥanbal remark: The ḥadīth, ‘The cupper and the one being cupped have broken the fast (2),’ and the ḥadīth, ‘There is no marriage without a guardian,’ resemble one another, and I hold to them.”
I say: Trustworthy transmitters have reported—from Ibn Jurayj, through Sulaymān ibn Mūsā, al-Zuhrī, ʿUrwah, and ʿĀʾishah—that the Prophet, peace and blessings be upon him, said: “Any woman who marries without the consent of her guardian, her marriage is invalid, her marriage is invalid. She is, however, entitled to her dower for what he has taken from her. If they dispute, the ruler is the guardian of whoever has no guardian (3).”
ʿĪsā ibn Yūnus transmitted it from Ibn Jurayj in a similar form, with the wording: “There is no marriage without a guardian and two upright witnesses.”
Ibn ʿAdī then said: “Yazīd ibn Abī Ḥabīb transmitted it alongside Sulaymān.”
