—Ibn ʿUmar; Jarīr transmitted it to us … and he narrated the ḥadith in full.
Al-Ḥākim then said: “Its chain is authentic and uninterrupted at the very point that is disputed.”
The ḥāfiẓ al-Ḍiyāʾ commented: “I suspect the word ‘from’ (ʿan) here is superfluous; otherwise it would be Muḥammad narrating from his father.”
I say: Aḥmad recorded it in his Musnad (1) through Yazīd, from Ibn Isḥāq, and gave nothing beyond the wording: “from his grandfather.”
Al-Dāraqutnī, in his Sunan, reported: Abū Bakr al-Naysābūrī narrated to us; Aḥmad ibn ʿAbd al-Raḥmān narrated to us; my uncle narrated to me; Makhramah ibn Bukayr narrated to us, from his father:
“I heard ʿAmr ibn Shuʿayb say:
‘I heard Shuʿayb say:
“I heard ʿAbd Allāh ibn ʿAmr say:
‘I heard the Messenger of Allah ﷺ say: “In a sale, both contracting parties retain the option [to revoke] (2).”’”
Aḥmad also said: ʿAbd al-Razzāq narrated to us; Ibn Jurayj informed us; he said:
ʿAmr ibn Shuʿayb, from his father, from ʿAbd Allāh ibn ʿAmr, reported that the Prophet ﷺ said: “Any woman who is married on the basis of a dowry, a specified term, or a gift before the marital bond is secured—then it belongs to her (3).”
(1) 2/181. Also transmitted by Abu Dawud, no. 3893, in the Book of Medicine, “How to Perform Ruqya,” through the route of Hammad; by al-Tirmidhi, no. 3528, in “Supplications”; and by Ibn al-Sunni, p. 239, through the route of Ismail b. Ayyash—both chains going back to Muhammad b. Ishaq, then to Amr b. Shuayb, his father, and his grandfather. All the transmitters are reliable, but Ibn Ishaq narrates with ‘an‘ana (omitting direct affirmation of hearing). The report is corroborated by the mursal hadith found in Malik’s al-Muwatta, 2/950, which strengthens it. Al-Hafiz declared the tradition sound in Amani al-Adhkar, as cited by Ibn Allan in al-Futuhat al-Rabbaniyya.
(2) Reported by al-Darqutni, 3/50, with the wording: “Whenever a man buys from another man, each of them retains the option (to cancel) until they separate from the spot, unless the sale was concluded with an explicit option; and it is impermissible for either of them to leave his companion out of fear that he will not grant him release from the contract.” The same hadith is in Abu Dawud, no. 3456, al-Nasa’i, 7/251–252, and al-Tirmidhi, no. 1247, through the chain of al-Layth b. Sa‘d → Ibn ‘Ajlan → Amr b. Shuayb → his father → ‘Abd Allah b. ‘Amr b. al-‘As. The chain is sound (hasan).
(3) Recorded in Ibn Abi Shaybah’s al-Musannaf, no. 10739; Ahmad’s Musnad, 2/182; Ibn Majah, no. 1955, through Abu Khalid from Ibn Jurayj; and in al-Nasa’i, 6/120, and al-Bayhaqi, 7/248, through Hajjaj b. Muhammad from Ibn Jurayj. Ibn Jurayj employs ‘an‘ana and is known for tadlis (concealing the direct link). The phrase “before the ‘isma of marriage” means “before the marriage contract is concluded”; ‘isma refers to the binding protection created by the contract or any similar legal cause.
