but I fear that their hearts will not be able to bear it, and I would then find myself compromising and pursuing a share of worldly gain along with them (1).
Sufyān ibn ʿUyaynah reported, on the authority of Ibrāhīm ibn Maysarah:
“I said to Ṭāwūs, ‘He is the Mahdi’—meaning ʿUmar ibn ʿAbd al-ʿAzīz.”
He replied, “He is a Mahdi, yet not the [Promised] Mahdi, for he did not perfect justice in its entirety.”
Ibn ʿAwn said: Whenever Ibn Sīrīn was asked about ṭilāʾ (2), he would say, “An Imām of guidance—for he meant ʿUmar ibn ʿAbd al-ʿAzīz—has prohibited it.”
Ḥarmalah stated: I heard al-Shāfiʿī say, “The caliphs are five: Abū Bakr, ʿUmar,”
(1) Its full wording is recorded in the author’s Taʾrikh, 4/170: “If your hearts object to this, they will feel at ease with that.” In al-Bidaya, 9/200, it reads: “I certainly wish to carry out the matter, yet I only implement it with some worldly incentive so that their hearts may be reassured.”
(2) al-tilaʾ (with a short i and a long a) is grape juice that has been boiled down; it is the same as rubb (concentrated syrup). ʿUmar b. al-Khattab, Abu ʿUbayda and Muʿadh deemed it permissible to drink once it is reduced to one-third, two-thirds having evaporated. Malik (2/847) reports through Mahmud b. Labid al-Ansari that when ʿUmar arrived in Syria the people complained about the land’s unhealthy climate, saying, “Only this drink benefits us.” ʿUmar replied, “Drink honey.” They said, “Honey will not help.” A local man suggested, “Shall we prepare a portion of this drink that does not intoxicate?” ʿUmar agreed; they boiled it until two-thirds were gone and one-third remained. When they brought it to ʿUmar he dipped his finger into it, lifted it out and the liquid stretched after it. He said, “This is tilaʾ, like the paste put on camels.” He then ordered them to drink it. ʿUbadah b. al-Samit exclaimed, “By Allah, you have made it lawful!” ʿUmar replied, “No, by Allah. O Allah, I do not declare lawful what You have prohibited, nor prohibit what You have made lawful.”
Saʿid b. Mansur transmits through Abu Majliz from ʿAmir b. ʿAbd Allah that ʿUmar wrote to ʿAmmar: “A caravan has arrived bearing a black drink like camel tilaʾ. They say they boil it until two foul thirds disappear—one third of its odor and one third of its excess—so instruct those with you to drink it.” Saʿid b. al-Musayyib likewise reports that ʿUmar permitted any beverage boiled until two-thirds evaporate and one-third remains. Al-Nasaʾi (8/329) relates, through ʿAbd Allah b. Yazid al-Khatmi, that ʿUmar wrote: “Boil your drink until the devil’s share departs, for the devil has two portions and you have one.”
Ibn Hajar comments in Fath al-Bari, 10/55: “These chains are sound, and some explicitly show that the only concern is intoxication; whenever it intoxicates it is forbidden.” The same judgment was held by ʿUmar and the others mentioned, as well as by Abu Musa and Abu al-Dardaʾ (reported by al-Nasaʾi), and by ʿAli, Abu Umamah, Khalid b. al-Walid and others (reported by Ibn Abi Shaybah). Among the Successors are Ibn al-Musayyib, al-Hasan and ʿIkrimah; among the jurists, al-Thawri, al-Layth, Malik, Ahmad and the majority. Their condition is that the drink must not intoxicate, though a group still regarded its use as disliked out of piety.
