al-Musayyab, who said:
“I heard ʿUmar on the pulpit saying, ‘If I find anyone who has had intercourse and has not performed the ritual bath—whether or not ejaculation occurred—I shall punish him.’ (1)
Ibn ʿUyaynah relates—through Yaḥyā ibn Saʿīd—from Ibn al-Musayyab, who said:
“I was born two years into ʿUmar’s caliphate, and his caliphate lasted ten years and four months.” (2)
Al-Wāqidī reports: Hishām ibn Saʿd told me, “I heard al-Zuhri. He was asked, ‘From whom did Saʿīd ibn al-Musayyab take his knowledge?’ He replied, ‘From Zayd ibn Thābit.’ He also sat with Saʿd [ibn Abī Waqqāṣ], Ibn ʿAbbās, and Ibn ʿUmar; he visited the wives of the Prophet—ʿĀʾishah and Umm Salamah, may Allah be pleased with them—and he heard …”
(1) The transmitters are trustworthy, and the report supports those who hold that Saʿid met and heard directly from ʿUmar. Al-Hafiz Ibn Hajar, in Tahdhib al-Tahdhib 4/87, cites another hadith with an unimpeachable chain in which Saʿid explicitly says he heard from ʿUmar.
In the earliest period of Islam the ruling was that a man who had intercourse but withdrew before ejaculation (iksal) was not obliged to perform ghusl (the major ritual bath). Al-Bukhari (Sahih 1/338) narrates from Zayd b. Khalid al-Juhani that he asked ʿUthman b. ʿAffan: “What do you say if a man cohabits with his wife and does not ejaculate?” ʿUthman replied, “He should make wuduʾ as he does for prayer and wash his private part.” ʿUthman added, “I heard this from the Messenger of Allah.” Zayd continues: “I then asked ʿAli b. Abi Talib, al-Zubayr b. al-ʿAwwam, Talha b. ʿUbayd Allah and Ubayy b. Kaʿb, and they all gave the same ruling.”
This was later abrogated, and ghusl became obligatory even without ejaculation.
Ahmad (5/115–116), Abu Dawud (214) and al-Tirmidhi (110) report, through al-Zuhri, from Sahl b. Saʿd, from Ubayy b. Kaʿb, that the dictum “al-maʾu min al-maʾ” (“water because of water”) applied at the beginning of Islam; afterwards it was set aside, and people were ordered to perform ghusl whenever “the two circumcised parts meet”. Al-Tirmidhi graded this hadith sound and authentic.
A second chain is given by Abu Dawud (215), al-Darimi (194) and al-Bayhaqi, Sunan 1/165–166, from Abu Hazim, from Sahl b. Saʿd: Ubayy b. Kaʿb told me that the legal opinion “al-maʾu min al-maʾ” was a concession granted by the Messenger of Allah at the start of Islam, after which he commanded the performance of ghusl.
Al-Darqutni records it in his Sunan, p. 46, and pronounces it authentic; Ibn Hibban (nos. 228–229) and Ibn Khuzayma likewise declare it sound.
Al-Baghawi, in Sharh al-Sunnah, notes that those who continued to follow the first view—that iksal does not require ghusl—included Saʿd b. Abi Waqqas, Abu Ayyub al-Ansari, Abu Saʿid al-Khudri and Rafiʿ b. Khadij; the scholar Sulayman al-Aʿmash shared their opinion.
