pledged allegiance, kept quiet, and raised no objection(1); on that basis he departed(2).
He then claimed Ziyād as his own brother(3) and, after al-Mughīrah’s death, appointed him governor of Kūfa. He wrote to Ziyād concerning Ḥujr ibn ʿAdī and his companions; Ziyād sent them to him, and he had them executed at Marj ʿAdhrāʾ(4).
He subsequently placed both Kūfa and Basra under Ziyād’s authority; when Ziyād died, he assigned the two provinces to Ziyād’s son, ʿUbayd Allāh ibn Ziyād.

(3) Muslim relates in his Sahih (no. 63, Book of Faith, chapter: “The faith-status of one who knowingly disowns his true father”) through the isnad of Abu Uthman: “When Ziyad was publicly acknowledged, I met Abu Bakra and said, ‘What have you people done? I heard Saad b. Abi Waqqas say, My two ears heard the Messenger of Allah ﷺ say: Whoever in Islam claims as his father someone other than his real father, knowing that he is not his father, Paradise is forbidden to him.’ Abu Bakra replied, ‘I too heard it from the Messenger of Allah ﷺ.’ ” The marfu (prophetic) portion is also in al-Bukhari, 12/46 (Book of Inheritance).
Al-Hafiz explains: The man claimed as a son was Ziyad b. Sumayya—Sumayya being his mother. She had been a slave-woman of al-Harith b. Kalda, the husband of a freedman named Ubayd, and she bore Ziyad on al-Harith’s bed while they were in Taif before that city accepted Islam. In Umar’s caliphate Abu Sufyan b. Harb once heard Ziyad speaking eloquently before Umar and said, “I know who placed him in his mother; were it not for my fear of Umar I would name him.” When Muawiya later became caliph, Ziyad was governor of Fars for Ali. Seeking to win him over, Muawiya hinted that he would affiliate him to Abu Sufyan. Ziyad accepted, and after a series of developments Muawiya formally recognised him as Abu Sufyan’s son, appointed him over Basra and then Kufa, and honoured him. Many Companions and Successors objected, citing the hadith al-walad lil-firash (the child belongs to the marital bed).

Al-Hakim records in al-Mustadrak, 3:469, through Ismail b. Ulayya – Hisham b. Hassan – Ibn Sirin: When Ziyad once stretched out his sermon, Hujr b. Adi called, “The prayer!” Ziyad continued, so Hujr repeated, “The prayer!” and reached for pebbles; the people did likewise. Ziyad then descended, led the prayer, and afterwards wrote to Muawiya about him. Muawiya answered: “Send him to me.” When Hujr arrived he greeted him, “Peace be upon you, O Commander of the Believers.” Muawiya replied, “Commander of the Believers—me? I shall neither excuse you nor accept your excuse,” and ordered his execution. As they led him away he asked permission to perform two rakas; when he finished he said, “Do not remove the iron from me, do not wash my blood away, and bury me in my clothes, for I shall plead my case.” He was then killed.
