ibn Baṣīr ibn Warqaʾ al-ʾUwdanī al-Bukhārī.
Owdan is one of the villages of Bukhara; al-Samʿānī says its first consonant is pronounced with ḍamma, whereas Ibn Mākūlā and others read it with fatḥa. (1)
He heard ḥadith from: Yaʿqūb ibn Yūsuf al-ʿĀṣimī, al-Haytham ibn Kulayb al-Shāshī, Muḥammad ibn Ṣābir, and ʿAbd al-Muʾmin ibn Khalaf.
Narrators from him include: al-Ḥākim, Abū ʿAbd Allāh al-Ḥalīmī, Abū ʿAbd Allāh Ghunjar, Jaʿfar ibn Muḥammad al-Mustaghfirī, and others.
He was the leading Shāfiʿī authority of his time in Transoxiana and belonged to the Ashāb al-Wujūh. He maintained: “Ribā (usury) is forbidden in everything; therefore it is unlawful to sell wealth for the same kind unless the two amounts are exactly equal.” (2)
Al-Ḥākim said: “He was—may Allah have mercy on him—among the most ascetic of jurists, the most devoted in worship, the most scrupulous, the quickest to weep over his own shortcomings, and the deepest in penitence and humility.”
He died in Bukhara in Rabīʿ al-Ākhir of 385 AH, may Allah have mercy on him.
