Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

ascending line. This descending line consists of the descendants: that is, sons, daughters, the children of sons, and the children of daughters, no matter how far removed. The testimony of any of them for another is not accepted, even if they are upright and all six of the previously mentioned conditions are fulfilled in them. Thus, if a father testifies for his son, his testimony is not accepted; if a son testifies for his father, his testimony is not accepted; if a child testifies for his mother, his testimony is not accepted; and if a mother testifies for her child, her testimony is not accepted. In short, this is an impediment. What is the proof that it is an impediment?

The proof is the strength of the presumption of bias, for a person is regarded with suspicion when he testifies for an ascendant or a descendant. Since he is liable to such suspicion, this prevents his testimony from being accepted, because he may have shown favoritism to his ascendants or descendants. Thus, the basis for considering this an impediment is a rationale, not evidence from the Quran and sunnah; namely, the strength of the presumption of bias. If we know that such suspicion is absent because the father or mother is outstandingly upright, such that no suspicion can attach to him or her, should we accept the testimony or not?

The author says that we do not accept the testimony, even if the father is among the most upright servants of Allah, or the son is among the most upright servants of Allah. This is because attaining such a degree of uprightness is rare, and what is rare carries no legal weight. What matters is what generally occurs, and generally a person is viewed with suspicion when testifying for his ascendants or descendants—especially in our present age, in which emotion has prevailed over reason and religious commitment for many people.

There is, however, another view on the matter: the testimony of ascendants for their descendants, and of descendants for their ascendants, is accepted when suspicion is absent, and each individual case is to be assessed on its own merits. The reasoning behind this is that nothing should be excluded from the general texts indicating the acceptance of the testimony of an upright person except on the basis of clear and manifest evidence with which we can compare
