I hold that photography is, in reality, a presentation of the actual state of affairs. So if he gives us the image without saying anything, it is as though he has presented the entire case to us—that is, he has presented to us an image of what actually occurred. In that case, we do not rely on his report; rather, we rely on the image before us. Allah Most High says:
“O you who believe, if an openly sinful person brings you any news, verify it.” [al-Hujurat 49:6]
If we verify it by means of the image, then what prevents us from accepting it? Suppose a disbeliever has a video camera, directs it at people who are fighting one another, and gives us the footage. We see them fighting each other and recognize their faces; then we say, “This is unacceptable because the one who recorded the footage is a disbeliever!” And we say that this is what the religion of Islam requires? I seek refuge in Allah! If we were to say such a thing, the nations would cry out against us: “What kind of religion is this, which does not accept transmitted facts?!”
Thus, if a disbeliever’s testimony rests solely upon his own report, it is unquestionably unacceptable, for he is not trustworthy. But if he records the reality for us in an image that leaves no room for doubt, then we do not accept his report as such; rather, we accept what is before us. Similarly, if a small boy of fourteen years comes forward to testify—though his body is large, he has neither grown pubic hair nor experienced ejaculation—we do not accept his testimony. But if he records the actual event for us on video and brings it to us, we accept it—not because of his report, but because the reality is before us and we can see it. This is why the Quran says, “Verify it,” meaning: seek clarification until the matter becomes clear to you. Once the matter has become clear, what prevents its acceptance?
If someone were to say: “We find in the Quran that the testimony of a non-Muslim is accepted.” Allah Most High says:
“O you who believe, when death approaches one of you, the testimony between you is...”
