I appoint you to judicial office throughout all the regions of the world.” This is impossible, because it would be impossible to encompass them all. Thus, generality of area is relative generality. For example, he may say, “I appoint you to judicial office in the Qasim region.” This is general with respect to each town individually, but it is not absolute generality. More general than this is for him to say, “I appoint you to judicial office in Najd.” This is broader, but is it absolute generality? No.
“I appoint you to judicial office in the Madinah region” is general; broader than that is “in the Hijaz region”; and broader than all of that is, “I appoint you to judicial office throughout the Hijaz and Najd.” The point is that generality of area means the place in which the judge exercises jurisdiction. Thus, he may be appointed with general jurisdiction or with limited jurisdiction. If he says, “I appoint you over all rulings throughout the Qasim region,” this is general jurisdiction over a general area.
“And he may be appointed with limited jurisdiction in both, or in one of them, ………”
His statement, “And he may be appointed with limited jurisdiction in both”: the pronoun in “both” refers to jurisdiction and area—that is, limited in jurisdiction and in area. An example concerning jurisdiction is for him to say, “I appoint you over marriage cases in Unayzah.” This is limited jurisdiction and a limited area: limited jurisdiction because he has restricted his judicial authority to marriage cases, and a limited area because he has restricted it to a particular town.
Or he may say, “I appoint you over inheritance cases in Buraydah.” This is limited jurisdiction over a limited area: limited jurisdiction because it is only in inheritance cases. If two people came before the one appointed over inheritance cases with a dispute concerning marriage, he would not judge between them. Indeed, if he judged between them without their agreeing to submit to his arbitration, his ruling would not be enforceable, because his jurisdiction was restricted to inheritance cases. Likewise, he has no authority to judge between two people in an inheritance matter in Unayzah, because the area is restricted to Buraydah. These are two corresponding examples:
