Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

the instruments used in slaughter, because the instrument used for hunting here is of two types, whereas in slaughter there is only one type.

His statement, “A sharp instrument, for which the same conditions apply as those required of a slaughtering instrument,” means that the first type is a sharp instrument, such as an arrow or a bullet. It is subject to the same conditions as a slaughtering instrument. It has already been mentioned that a slaughtering instrument must not be a tooth or a claw. Thus, if one takes a tooth, throws it, and kills the game by its wound, it is not lawful, due to the general wording of the Prophet’s statement: “Eat whatever causes the blood to flow and over which Allah’s Name has been mentioned, except a tooth and a claw: as for a tooth, it is a bone; and as for a claw, it is the knife of the Abyssinians.” (1) Accordingly, the instrument must not be a tooth or a claw.

It is not a condition that the instrument itself be lawfully owned. Thus, if one makes an arrow from gold, what he hunts with it is lawful. Likewise, if he unlawfully takes an arrow and shoots with it, what he hunts is lawful, as mentioned previously, because this instrument causes a wound.

His statement, “and it must cause a wound,” means that it is also stipulated that it wound the game, such that it kills the game by wounding it. The opposite is for it to kill by its weight. If it kills by its weight, then, Allah willing, it will be explained that it is not lawful. The evidence is the previously cited statement: “Eat whatever causes the blood to flow and over which Allah’s Name has been mentioned,” for it applies to both slaughter and hunting. Hunting differs from slaughter, however, in that slaughter requires severing the windpipe and the esophagus, or the two jugular veins, according to the previously mentioned disagreement. In hunting, by contrast, this may occur at any part of the body. This is one of the ways in which the rulings of hunting are more lenient than those of slaughtered animals: the place where the blood is caused to flow
