“A woman’s two labia”: the initial hamzah may be pronounced with either fatḥah or kasrah. They are the two edges of a woman’s private part. Thus, if someone assaults her and severs them, the full blood-money is due for both, and half the blood-money for one.
The same applies to the two kidneys: whoever removes one of them owes half the blood-money, while for both the full blood-money is due, in accordance with the principle. The jurists did not discuss this organ because it is internal. In my view, however, it should be discussed, because people now treat this internal organ like an external one.
For the two nostrils, two-thirds of the blood-money is due; for the septum between them, one-third of it; for the four eyelids, the full blood-money; for each eyelid, one-quarter of it; for the fingers of the two hands, the full blood-money, just as for the toes; for each finger, one-tenth of the blood-money; for each phalanx, one-third of one-tenth of the blood-money. The thumb has two joints, and for each joint, half of one-tenth of the blood-money is due, like the indemnity for a tooth.
His statement, “For the two nostrils, two-thirds of the blood-money is due, and for the septum between them, one-third of it”: they are called nostrils because nasal discharge comes out through them. The septum between them is well known. All of this is called the soft part of the nose, namely, the pliable portion of it.
Thus, the soft part of the nose comprises three things: the two nostrils and the septum between them.
If a person cuts off one nostril, he owes one-third of the blood-money: thirty-three camels and one-third of a camel. If he cuts off the second nostril, he owes sixty-six camels and two-thirds of a camel. If he cuts off the septum between them, he owes one hundred camels; but if he cuts off the septum alone, he owes one-third of the blood-money.
This is based on the preceding principle: whatever a person has only one of entails the full blood-money. As stated in the hadith of Amr ibn Hazm: “For the tongue, the full blood-money is due; for the penis, the full blood-money is due; and for the spine, the full blood-money is due” (1). All of this is a matter of scholarly consensus.
