forearm, then legal retribution is not carried out against him, because the severing was not at a joint. Accordingly, if a jurist among offenders wished to cut off someone’s hand yet avoid having his own hand cut off in retribution, he would cut from the middle of the forearm rather than at the wrist joint. He would thereby add to the injury while escaping legal retribution, because one of the conditions is that the severing be at a joint, whereas this is not at a joint. If it is not at a joint, we cannot be sure of avoiding excess when carrying out retribution: it may exceed or fall short of the injury, and the break may not be straight, making precise retribution impossible. This differs from a joint. This is the view adopted by the author.

It is also possible to say that retribution should be carried out at the joint below it, while he is charged financial compensation for the excess, as will come under the discussion of wounds, Allah willing. This compensation is what is termed in the chapter of blood-money payments ḥukūmah (judicially assessed compensation), and it will, Allah willing, be discussed separately. This applies when retribution cannot be carried out at the site of the severing. But if retribution can be carried out at the site of the severing, then it is carried out against him, for Allah Most High says: “And wounds are subject to legal retribution.” [al-Ma'idah 5:45] Whenever retribution is possible, it is obligatory. Thus, if qualified doctors are available and say, “We can assess this injury precisely, such that we exact retribution from the offender without any excess whatsoever,” then what would prevent retribution? Nothing would prevent it. Indeed, if the victim said, “I waive my claim: he cut off my hand from the middle of the forearm, and I will cut his off from one-third of the forearm, waiving the excess,” then what would prevent it? Nothing would prevent it. This is a man who has waived part of his right in order to exact retribution from this unjust aggressor.

Thus, contrary to the author’s view, there are three possibilities:

The first is that retribution be carried out at the joint below the site of severing, and that he be charged compensation for the excess.
