The Book of Divorce
His statement: “Divorce”: this is a verbal noun derived from ṭallaqa (“to divorce”). A verbal noun agrees with the infinitive in meaning but differs from it in its letters. It is derived from release and letting go, the opposite of restraint. This is because marriage is a contract and a bond; when the woman is separated, that bond is released. Thus, we say that its technical definition is: “the dissolution of the bond of marriage, in whole or in part.” If it is an irrevocable divorce, it dissolves the entire bond of marriage; if it is a revocable divorce, it dissolves part of it. Hence, when he divorces her once, one divorce is deducted and he has two divorces remaining; and when he divorces her twice, he has one remaining.
When you reflect upon this, you find that authority lies in the husband’s hand, while the woman is with him like a tethered she-camel. This is why the Prophet, may Allah’s peace and blessings be upon him, instructed us to fear Allah concerning women, and said: “They are captives in your hands” (1). A captive is a prisoner. This makes clear the advantage with which Allah has favored men over women, and we recognize that those who call for equality between men and women have opposed Allah, Most High, in His creational and legislative decree. For a woman is not equal to a man: neither in physical constitution, nor in character, nor in intellect. Thus, she is not his equal in any respect.
But those people—may Allah protect us—have been steeped in what the enemies possess
