to keep away from his wife. Had this been part of Allah’s law, the Prophet, peace and blessings be upon him, would have made it clear to anyone whose wife experienced irregular bleeding, and it would have been transmitted in order to preserve the Sacred Law. Since none of this occurred, it is known that it is not forbidden.
-
The original presumption is permissibility.
-
Menstrual blood is not like the blood of irregular bleeding, either in its nature or in its rulings. This is why a woman experiencing irregular bleeding must pray. If prayer is permitted for her despite this blood, then how could intercourse with her not be permitted? The prohibition of prayer is more serious than the prohibition of intercourse.
Nor is it conceded that she is included in the verse, for Allah says: “They ask you about menstruation. Say, ‘It is harm.’” [al-Baqarah 2:222] His saying, “It,” is a pronoun that indicates specification; that is, it—and nothing else—is harm. Moreover, analogy is not accepted in most rulings, so how can this case be analogized to it under these circumstances?
- Menstruation lasts only a short time, so abstaining from intercourse during it is a minor matter. Irregular bleeding, however, lasts for a long time; thus, forbidding intercourse except where there is fear of hardship entails difficulty, and hardship is negated in the Sacred Law.
As for the fact that the penis becomes soiled with impure blood during intercourse: if we hold that a small amount of irregular-bleeding blood is excused, then there is no issue, since what adheres to the penis is slight. If we hold that it is not excused, then this is unintended and non-continuous contact with the blood, since he must wash it afterwards.
But if he finds it repulsive and dislikes having intercourse while seeing the blood, this is a personal matter that carries no legal ruling. A person may dislike something by natural aversion, and he is not blamed if he avoids it, just as the Prophet, peace and blessings be upon him, disliked eating lizard, even though it is permissible.
