and despite that, they say it is permissible: he pays one thousand immediately, and then, if he takes her out of her town, he pays the second thousand; otherwise, he owes her nothing. Here they say this is because she has a known interest in it. Many women do not like to leave their town, especially when they have relatives there—such as a mother, father, paternal uncles, and maternal uncles. “If the bridal gift, or part of it, is deferred, it is valid, …”
His statement, “If the bridal gift, or part of it, is deferred, it is valid,” means that if the entire bridal gift, or part of it, is deferred, such deferment is valid. This necessarily entails that the specified bridal gift itself is valid. The apparent meaning of the author’s words is that this is permissible, since validity is contingent upon permissibility: everything that is valid is permissible, and everything prohibited is invalid. Thus, when they say that it is valid, this means that it is not prohibited, for what is prohibited cannot be valid.
But is it merely permissible, or is it disliked? The established position of the school is that it is permissible and unobjectionable, because it is like other forms of consideration. Allah the Exalted says: “That you seek them with your wealth,” [al-Nisa 4:24] where the preposition denotes consideration in exchange. The command to fulfil includes fulfilment of the contract itself and of whatever has been stipulated within it, because contractual conditions are attributes of the contract. Therefore, if fulfilment of the contract is binding, it necessarily follows that I must fulfil both the contract and the attributes it entails, namely its conditions. The default rule concerning conditions is permissibility. Allah the Exalted says: “And fulfil every commitment. Indeed, every commitment shall be
