Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

but what he means is when his desire becomes intense in a land where fornication is readily accessible. If it is not readily accessible, then, even if his desire becomes intense, he cannot commit fornication. Thus, if he fears fornication because its means are present and its impediments absent, marriage becomes obligatory for him in order to avert this harm. This is because abstaining from fornication is obligatory, and whatever is necessary to fulfil an obligation is itself obligatory.

Some scholars have said that it is obligatory without qualification, and that its basic ruling is obligation. This is because the Prophet, peace and blessings be upon him, said: “O young men, whoever among you is able to marry, let him marry.” The imperative verb denotes a command, and the basic rule regarding a command is that it signifies obligation unless there is evidence diverting it from that meaning. Moreover, refraining from marriage despite being able to marry entails imitating the Christians, who shun marriage as a form of monasticism; and imitating non-Muslims is forbidden. It is also due to the immense benefits it brings about and the many harms it wards off, for it is more effective in lowering the gaze and more protective of chastity. However, according to this view, ability is an essential condition, because the Prophet, peace and blessings be upon him, made it conditional upon ability, saying: “Whoever among you is able to marry.” This is also because the general principle concerning every obligation is that ability is one of its conditions.

In my view, the position that it is obligatory is closer to what is correct: a person who has sexual desire and is able to marry is obliged to marry. However, the well-known position of the legal school is what the author has mentioned.

When is it permissible? It is permissible for one who has no sexual desire, provided that he is wealthy, because there is no cause making it obligatory; rather, it is for the wife’s benefit, through supporting her and other such matters.

If he intends by it to preserve the wife’s chastity and protect her private parts, then it is recommended.
