and considers the case; her claim is not accepted except with evidence.
The sound view is that there is no fixed minimum for the interval of purity, as Shaykh al-Islam chose, and the author of al-Insaf inclined to this view, saying, “It is the correct view.” (1)
Nor is there any fixed maximum for it, ……….
His statement, “Nor is there any fixed maximum for it,” means that there is no fixed maximum for the interval of purity between two menstrual periods, because some women are found never to menstruate at all. This is correct.
A menstruating woman makes up the fast, but not the prayer; neither is valid from her; rather, both are prohibited for her, …………
His statement, “A menstruating woman makes up the fast, but not the prayer,” conveys four rulings:
First: she does not fast.
Second: she does not pray.
Third: she makes up the fast.
Fourth: she does not make up the prayer.
As for the first and second, they are understood by necessary implication and indication, since an implication of the statement, “She makes it up,” is that she did not perform it.
As for the third and fourth, they are understood from the explicit wording of the author’s statement; its indication falls under direct correspondence.
The evidence for this is as follows:
- When the women asked the Prophet ﷺ, “What is the deficiency in our religion and intellect?”
