a female vulva and a penis, and urinates from the penis but not from the female vulva, and does not menstruate, then this is what they call an intersex person of clear sex.

What should we do with the intersex person whose sex is indeterminate? We say: if the heirs agree to wait until the person grows up, reaches puberty, and can be assessed—or until surgery is performed, as in our present time—then that is what should be done. But if they do not agree, the author says:

“The person inherits half the share of a male and half the share of a female.”

This is equitable, because as long as the person’s sex remains indeterminate, we must exercise caution. Thus, we say: you receive half the share of a male and half the share of a female. For example, if a deceased person leaves behind two sons, one of whom is intersex, then the male-case calculation is based on two shares, while the female-case calculation is based on three shares. In the male-case calculation, the intersex child receives one share and the sibling one share; in the female-case calculation, the intersex child receives one share and the sibling two shares. The two calculations have no common factor, so we multiply one by the other, yielding six. We then say: whoever receives a share in one of the two calculations receives it multiplied by the other calculation.
