the Prophet, peace and blessings be upon him: “The bond of emancipation is a kinship bond, like the bond of blood relationship.” (1)
“Bond” here means a connection akin to that of blood kinship. If there is no emancipator, then his agnatic heirs inherit; but only those agnatic heirs who inherit in their own right. Accordingly, if a freed slave dies leaving the son and daughter of his former master, the master’s son is the residuary heir, while the master’s daughter receives nothing, because in matters of the bond of emancipation, only agnatic heirs who inherit in their own right may inherit.
If someone asks, “How can the master’s daughter receive nothing alongside her brother?” we say: Just as a brother’s daughter receives nothing alongside her brother, so this is not unusual.
