The maternal grandmother, the paternal grandmother, and the mother of the paternal grandfather inherit one-sixth, even if they ascend through mothers...
His statement, “The maternal grandmother, the paternal grandmother, and the mother of the paternal grandfather inherit one-sixth, even if they ascend through mothers”: the maternal grandmother inherits even if she is separated by successive mothers—that is, the mother of the mother of the mother, and so on, until one reaches Eve.
The same applies to the paternal grandmother: the mother of the father, the mother of the mother of the father, the mother of the mother of the mother of the father, and so forth.
Likewise, the mothers of the paternal grandfather—that is, the father’s father—inherit one-sixth, even if they ascend through mothers. Thus, only three categories of grandmothers inherit. As for the mother of the father’s father’s father, we have previously mentioned that, according to the established position of the school, she does not inherit, whereas the stronger view is that she does inherit.
The prescribed share of grandmothers is among the simplest of shares: grandmothers can never inherit one-third, one-half, or two-thirds. Their inheritance is one-sixth only, whether or not there is an inheriting descendant, whether or not there are siblings, and whether or not there is a residuary heir. However, among grandmothers, only these three categories inherit: the mother of the mother, the mother of the father, and the mother of the paternal grandfather—namely, one’s father’s father—even if they ascend through mothers. That is, there is no male between them: the mother of the mother of the mother, and so on; the mother of the mother of the father, and so on; and the mother of the mother of the paternal grandfather, and so on. As for the mother of the father’s father’s father, according to the established position of the school she does not inherit; but the correct view is that she does inherit, and that every woman connected to the deceased through an heir is herself an heir. This is a principle of the law of inheritance.
