we return to the bequest and consider whether it exceeds one-third of what remains after the debt. If it does, no more than one-third is executed. Thus, if we assume that a man possesses forty thousand riyals and owes a debt of ten thousand riyals, and he has bequeathed one-third, then in this case we set the bequest at ten thousand riyals. Had we considered the bequest before the debt, it would have been thirteen thousand, three hundred and thirty-three and one-third riyals. But we consider the bequest only after the debt has been settled: we first discharge the debt, then consider one-third of what remains and execute the bequest from it. Hence he said: “from all his wealth after his death, even if he did not make a bequest concerning it”—that is, even if the deceased debtor did not instruct that it be paid, because it is an obligation due from him. It has previously been explained that if this debt is unsupported by evidence, he must make a bequest concerning it.

If he says, “Pay the obligation from one-third of my estate,” it is to be given priority. If anything remains from it, the recipient of the voluntary bequest takes it; otherwise, it lapses.

His statement, “If he says,” means the deceased.

His statement, “Pay the obligation from one-third of my estate; it is to be given priority. If anything remains from it, the recipient of the voluntary bequest takes it; otherwise, it lapses”: “the obligation” means the pilgrimage, an expiation, or a debt. We therefore separate one-third from the estate and begin with it, discharging the debt from that third. The debt may exceed one-third, be less than it, or equal it. If it equals it, the matter is clear. For example, if he says, “Pay the obligation from one-third of my estate,” and, after he dies and we divide the estate, we find that one-third is ten thousand and that the debt is ten thousand, then we allocate the one-third, and there is no bequest for him, because he instructed that the debt be settled from one-third, and we have settled it.

The second case: insufficiency. When we divide the estate, we find that one-third is seven thousand while the debt is ten thousand. We discharge seven thousand of the obligation and take the remaining three thousand from the estate.
