with their paternal uncles. Thus, the second generation has no entitlement so long as even one member of the first generation remains.

Shaykh al-Islam, may Allah have mercy on him, said: Rather, they are entitled along with their paternal uncles. He explained this by saying that, when the child dies in this case, his own child becomes entitled, because it is generally not the grandfather’s intention to deprive his son’s children while their paternal uncles are still alive. Indeed, his concern for his grandchildren, who have been left bereft by their father’s death, may be greater than his concern for his own children. However, if there is a prevalent custom that such wording establishes succession from one generation to the next, and that the second generation has no entitlement alongside the first, then custom is to be followed. Better still is for the endower to state explicitly: “Whoever dies leaving a child, his share belongs to his child.”

His statement, “and supervision”: supervision here means legal authority. Those who manage the affairs of others fall into four categories: the agent, the executor, the administrator, and the guardian.

An agent acts during the principal’s lifetime, as when someone appoints another person to purchase a specified item for him, and he purchases it.

An executor is someone authorized to act after death. For example, a person may say: “I bequeath one thousand dirhams to So-and-so, and So-and-so is the executor.” That is, So-and-so is the one who receives the thousand and gives it to the beneficiary. Or he may say: “I appoint So-and-so as executor to oversee my minor children.”

An administrator is the agent appointed over an endowment. For this reason, many people who draft endowment documents make a mistake. For example, one may say: “I have endowed my house, or my date palms, for my children, and So-and-so is the agent.” This is incorrect. The proper wording is: “So-and-so is the administrator.” But since most of those who prepare documents for people have not studied fiqh in depth,
