Shaykh al-Islam said: This is among that which the Lawgiver has excused, for it has not been reported from the Prophet ﷺ that he ordered the washing of game caught by a dog where the dog’s mouth had touched it. (1)
Moreover, the Messenger ﷺ said, “If it licks [from a vessel],” (2) and did not say, “If it bites.” When drinking, things may come out of its stomach that do not come out when it bites. There is no doubt that the Companions, may Allah be pleased with them, did not wash the meat seven times, one of them with soil. This indicates that it is excused. Allah, glorified be He, is the All-Powerful, the Creator, and the Legislator; when something is excused in the Sacred Law, its harm is removed by Allah’s decree. For example, carrion is impure and forbidden, but when a person is compelled to eat it, it becomes lawful and contains no harm for the one compelled.
Before it was prohibited, donkey meat was wholesome and lawful to eat; once it was prohibited, it became foul and impure.
The correct view, then, is that it is not obligatory to wash that which a dog’s mouth has touched when it catches game, for the reasons mentioned above. Hunting with a dog is fundamentally based on ease; otherwise, Allah, mighty and majestic, could have required His servants to hunt the game themselves, rather than by trained dogs. This concession extends even to this case: what the dog’s mouth has touched need not be washed, and it is among that which Allah, Most High, has excused.
