Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

prostrate.” His instruction is to be followed, even if he is a disbeliever, so long as he is trustworthy. The same applies with regard to breaking the fast.

As for the stipulation made by some that the physician must be Muslim, it is open to question. The correct view is that the physician must be trustworthy, whether Muslim or non-Muslim. Many disbelievers possess trustworthiness, even though they do not seek nearness to Allah, Mighty and Majestic; rather, they want people to recognize their professional skill, proficiency, and sincere concern, so that they will turn to them.

If someone asks: What is your evidence for this? We say: Our evidence is the hadith of the migration.

Is it permissible to hire a disbeliever to construct mosques? The answer is: if we can ensure safety in doing so, and the person overseeing the work is a Muslim engineer, then there is no harm in it. But if that is not the case, then it is not permissible.

Nor is it valid for work whose performer must be among those qualified to draw near to Allah …

His statement, “Nor is it valid for work whose performer must be among those qualified to draw near to Allah”: this expression has been commonly used by the scholars, each generation receiving it from the one before. Its meaning is that no wage may be taken for any act that can only be performed as an act of worship. The reason is that, when an act can only be an act of worship, a person is not permitted to accept something of this world in exchange for the reward of the Hereafter.

Allah, Exalted is He, says:

“Whoever desires the life of this world and its adornment—We will fully repay them for their deeds therein, and they will not be deprived of anything in it. They are the ones for whom there will be nothing in the Hereafter but the Fire. What they accomplished therein has come to nothing, and all that they used to do is void.” [Hud]

Thus, Allah, Mighty and Majestic, warned against a person seeking anything of this world through his worship. He, Exalted is He, also says:

“Whoever desires the harvest of the Hereafter, We increase for him in his harvest; and whoever
