Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

“An agent appointed to conduct litigation may not collect [the debt], and the converse is likewise true. If one says, ‘Collect my due from Zayd,’ he may not collect it from Zayd’s heirs unless he says, ‘What is owed by him.’ An agent appointed to deposit property is not liable if he does not bring witnesses.”

The author’s statement, “An agent appointed to conduct litigation may not collect,” first indicates that agency in litigation is permissible—that is, one may appoint someone to litigate on one’s behalf.

But is it permissible to accept such an appointment or not? This requires further detail, for there are three possible cases: either you know that the principal is in the right, you know that he is in the wrong, or you are uncertain.

If you know that the principal is in the right, but his opponent is a contentious and argumentative litigant, then it is permissible for you to accept the appointment to litigate. Indeed, we may say that it is recommended, or even obligatory, because this rescues your brother’s right and aids both him and the wrongdoer: it aids him because you are the means by which his right reaches him, and it aids the wrongdoer by preventing him from committing injustice.

But if you know that he is in the wrong, yet he has chosen this agent because he is skilled in argument and can make falsehood appear true and truth appear false, then it is not permissible to accept this appointment, for Allah, Exalted is He, says:

“And do not cooperate in sin and transgression.” [al-Ma’idah 5:2]

If you are uncertain, then safety is preferable; that is, do not accept the appointment. Imam Ahmad, may Allah have mercy on him, regarded nothing as equal to safety, especially in our times, with the changing of the age and the differing standards of trustworthiness.

As for those who act as representatives and are called lawyers: if a lawyer asks, “Is it permissible for me to practise law?”

We say: this requires further detail. If you are acting as counsel for someone unable to repel injustice from himself, then this is good, and it falls somewhere between being obligatory or—
