Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

If he sells on deferred terms, then the sale is invalid, even if the deferred price is higher.

His statement: “Nor for other than the currency of the land.” The currency of this land, for us at present, is the Saudi riyal. If this man takes the item and goes off and sells it for dollars, the sale is invalid, because when I authorize you to sell and you sell for dollars, you have sold it for something other than what an unrestricted authorization naturally implies. Here, the dollar is not currency but a commodity: its value rises and falls. Thus, if he sells for dollars, the sale is invalid; and if he sells for Egyptian pounds, for example, this too is invalid. But if he appoints him as his agent in Egypt and he sells it for Egyptian pounds, then it is valid, because that is the currency of the land.

The apparent meaning of the author’s words is that he may not sell for other than the currency of the land, even if he sells for a more valuable currency.

For example, I appoint you to sell this car. Its value in the local currency is one hundred million, while its value in dollars is one thousand dollars; and he sells it for one thousand dollars. According to the author’s view, the sale is invalid, because it was not sold for the currency of the land, even though it is more valuable than the local currency. So should we say that the author’s statement is qualified to where the currency for which he sells is not more valuable than the local currency? It may be said that if the man sells it for a more valuable currency, we say that this is valid, because he has secured an additional benefit for him. It is like saying, “Sell it for dirhams,” and he sells it for dinars. Was not Urwah ibn al-Jaʿd appointed by the Messenger of Allah ﷺ to buy a sacrificial animal for him? He gave him one dinar, so he bought two sacrificial animals, sold one of them for a dinar, and returned to the Messenger of Allah ﷺ with a sacrificial animal and a dinar (1). He had lost nothing, and the Prophet ﷺ approved of what he had done. This indicates
