also, it is necessary that the goods stipulated in the salam contract should normally be available at the time they fall due. His statement, “and at the place of delivery,” refers to the place where delivery falls due. Thus, the author stipulates that the goods stipulated in the salam contract be available at the due time and place. If he sets a date at which the goods will not be available, the contract is invalid—for example, if he enters into a salam contract for grapes to be delivered in winter. This is invalid because grapes are not available in winter. In our present time, however, they may be available through refrigeration; thus, the statements of the jurists, may Allah have mercy on them, are qualified by this. Whenever the goods are available at the due time and place of delivery, the contract is valid.

His statement, “and at the place of delivery,” does not mean the place where the contract was concluded. The parties may conclude the contract in Unayzah while delivery is to take place in Riyadh; therefore, the goods must be available in Riyadh. What matters is the place of delivery, not the place where the contract was made. Evidence for this condition is what is indicated by the hadith of Ibn Abbas, may Allah be pleased with him: “They used to make advance payments for fruits for one or two years.” It is well known that advance payment for fruits is made only in the place where they are available. How could a person make advance payment for fruits in a place where they are unavailable? This is one consideration. Another is the underlying rationale: if they are unavailable at the place and time of delivery, this will lead to dispute and contention between the purchaser and the seller.

His statement, “not at the time of the contract,” means that it is not stipulated for the goods subject to the salam contract to be available when the contract is concluded. This is because the goods are an obligation owed, rather than a specific, designated item. Once he specifies a term at which they will be available, it is not a condition that they be available at the time of the contract. The author explicitly states, “not at the time of the contract,” in order to negate the disagreement on this issue, for some scholars held that it is a condition that
