Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

of the original contract, nor is it a new contract. Thus, if a man comes and buys a car from me, then comes seeking rescission and dissolution of the sale, then if I dissolve the sale, that is rescission by mutual agreement. But if I say, “I will not dissolve the sale; rather, I will buy it from you in a new purchase. You bought it from me for ten thousand and paid the price, and I will buy it from you for eight thousand riyals,” then this is a sale.

His statement, “It is permissible before taking possession of the item sold”: this applies even if the item sold is measured or weighed. Thus, if someone sells another person a sack of wheat at one dirham per sāʿ, he may not sell it to anyone—not even to its original seller—until he takes possession of it by measuring it. However, if he asks to rescind the sale and the seller agrees, it is valid, because this is not a sale; rather, it is an annulment—that is, a cancellation of the original contract, so that matters return to their former state. If we were to say that it is a sale, it would not be permissible for him to grant rescission until he had taken possession of it and received it in full.

His statement, “For the same price”: that is, it is permissible only for the same price. It is not permissible with an increase, a decrease, a difference in type, or a difference in kind.

For example, a buyer purchases this car for one hundred dinars, then regrets it and says to the seller, “Grant me rescission.” The seller replies, “I will grant it on condition that you give me dirhams instead of the dinars.” In this case, the rescission is invalid, because he granted it for something other than the same price—that is, for a different type—since it has changed from an annulment into an exchange and currency transaction.

Another example: he buys this car for fifty thousand, then returns to the seller and says, “Grant me rescission.” The seller replies, “I will grant it on condition that you give me five thousand riyals.” This is not permissible, because it has now increased beyond the original price; it will
