session, even if he sleeps for a long time, because he has not departed this life, unlike one who dies.

Third: when a person is overcharged in a sale by an amount exceeding customary limits, or through the price inflation of a deceptive bidder or the exploitation of an unsuspecting buyer.

His statement, “Third: when he is overcharged in the item sold by an amount exceeding customary limits”: “Third” means the third type of option: the option due to unfair disparity in price. He indicated this by saying, “when he is overcharged in the item sold.” The same applies if he is underpaid in the price—for example, if the price is not money, or if it is counterfeit currency, and the like. The point is that he has suffered an unfair disparity in the sale that exceeds what is customary.

Unfair disparity literally means being overcome. Thus, if he has been bested to an extent that exceeds what is customary, he has the option. The author qualified unfair disparity as that which exceeds customary limits. For example, if he is overcharged by one riyal out of a million—such as buying land for one million when it is worth one million less one riyal—this is the sort of disparity people normally overlook. The same is true of one part in a thousand, and one part in a hundred: this does not exceed customary limits. But would one part in ten be considered an unfair disparity?

It appears to me that it is considered an unfair disparity, especially when cash is scarce among people, for one part in ten may be burdensome for many people when liquidity is limited. But when money is abundant, it may be said that one part in ten is insignificant.

Some scholars have said that the unfair disparity which exceeds customary limits is one part in five. One part in five amounts to twenty percent. Yet there is some reservation about this. Rather, it should be said that making the matter dependent on customary practice is better. If we differ, we refer back to those with expertise—to the reputable brokers in the locality—and ask them: What do you say about someone being overcharged by one part in ten? It may also be said that this differs according to the type of property: in some cases, one part in ten is an unfair disparity, while in others it is not.
