Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

that the seller retain the benefits of the sold item for one year, it is valid. Here, the condition conflicts with the basic implication of the contract, not with a contract that is unqualified by conditions. For if the contract were complete and fully effective, the seller would not be entitled to the benefits even for a single day. Moreover, there may be a need for this.

Likewise, it is valid to stipulate an option at the time of the contract, after the contract, or during the option period—whether it is an option stipulated by condition or the option of the meeting. But how can this be done during an option stipulated by condition? The answer is that one condition may be added to another. For example, someone may say: “I have bought this house from you, with an option for three days.” Then, when the third day arrives, he says: “I wish to extend the option to six days.” He may do so, because the contract has not yet become binding; it becomes binding only once the option period has ended.

His statement, “for a known period, even if lengthy,” indicates that the period must be known—for example, by saying: “until the beginning of the month of Rajab,” or “until such-and-such a day,” or “until such-and-such a year.” If he says, “until the harvest season and the date harvest,” the established position of the school is that this is invalid, because the time of harvest varies: some people harvest early, while others harvest late. Likewise, the date harvest varies, so it is invalid because it is not known. The second view is that it is valid, and the ruling is tied either to its customary time or to its beginning. The matter is close, and this is the correct view.

His statement, “for a known period,” excludes an unknown period. Ibn al-Qayyim chose the view that an unknown period is permissible if it has an endpoint, such as when someone says: “I sell you this house, but I retain the option until I purchase a house.” This has an endpoint. Yet, even if we say that this view has merit, an upper limit should be specified—for example: “I retain the option until I purchase a house, provided that it does not exceed one month,” so as to prevent undue delay.
