Know that whenever a person resorts to a legal stratagem to circumvent something forbidden, he only increases himself in wickedness. What is forbidden is evil, and when you devise a stratagem to evade it, it becomes even more evil, because you have combined the forbidden act itself with deceiving the Lord, Mighty and Majestic—yet nothing whatsoever is hidden from Allah. “Actions are only by intentions.” (1) Were it not for the usurious increment, you would not have known this man.
What is astonishing is that Satan deceives the son of Adam, saying: “We do this out of mercy for the poor person, so that his circumstances may be eased; without this, they would not be eased.” But I say: the poorer he is, the greater the increment imposed upon him becomes. This, then, is a punishment, not mercy. For example, a person of moderate means comes to borrow from this man, and he sells him something worth one thousand for one thousand two hundred. Then another person comes to borrow because he and his family need to eat, and he sells him something worth one thousand for one thousand five hundred, saying, “This man is unable to repay; when will he ever repay?” So where is the mercy? If his aim were truly to show mercy to the poor, then this second man would be more deserving of mercy than the first, who is of moderate means. But Satan toys with the son of Adam.
His statement, “or bought something for cash,” indicates that the purchase is what is forbidden. As for the initial sale, the author’s words indicate that it is lawful. However, if we know that they have adopted it as a legal stratagem, then the initial sale is also invalid, because it has become a means to something forbidden, and the means to what is forbidden are themselves forbidden. Consider how Islamic law closes the door to usury most firmly, for people are naturally inclined to love wealth and therefore seek stratagems to obtain it by every possible means. The Law’s protection against usury and its effort to keep people away from it are plainly evident in the Shariah, just as the Shariah safeguarded tawhid (pure monotheism) and nullified everything that
