- The hadith of Jabir ibn Abd Allah (may Allah be pleased with him): “The final ruling of the Messenger of Allah (peace and blessings be upon him) was to abandon ablution after eating anything touched by fire.” It was narrated by the compilers of the Sunan (1).
The point of evidence is that his words, “anything touched by fire,” are general and include camel meat and other things. Moreover, he explicitly stated, “The final ruling.” If it was the final ruling, then we must follow the later ruling of the Sacred Law, because the later ruling abrogates the earlier one.
- The hadith of Ibn Abbas: the Prophet (peace and blessings be upon him) said, “Ablution is required because of what comes out, not because of what goes in.” (2)
(1) Narrated with this wording by Abu Dawud, Book of Purification, chapter: Abandoning wudu after eating that which has been touched by fire, no. 192; al-Nasai, Book of Purification, chapter: Abandoning wudu after eating that which has been altered by fire, 1:108, no. 185; and Ibn Hibban, no. 1134, through Shuayb ibn Abi Hamzah, from Muhammad ibn al-Munkadir, from Jabir. It has been criticized on two grounds:
1. It is an abridgement of Jabir's longer hadith: that the Prophet performed wudu, then ate bread and meat, then prayed without performing wudu. This was stated by Abu Hatim al-Razi, Abu Dawud, Ibn Hibban, and Ibn Hajar.
Abu Hatim al-Razi said: “This hadith has a disturbed text. Rather, it is that the Prophet ate a shoulder and did not perform wudu. This is how the reliable narrators reported it from Ibn al-Munkadir, from Jabir. It is possible that Shuayb narrated it from memory and erred concerning it.” Al-Ilal, by his son, 1:64, no. 168.
2. Al-Shafii said: Ibn al-Munkadir did not hear this hadith from Jabir; rather, he heard it from Abdullah ibn Muhammad ibn Aqil. Al-Talkhis al-Habir, no. 155. Abdullah was reliable, though there is some weakness in his hadith, and it is said that his precision declined later in life, as stated in al-Taqrib.
Its meaning is supported by the report narrated by al-Bukhari, no. 5457, from Jabir, who was asked whether wudu is required after eating that which has been touched by fire. He replied: “No.”
(2) Narrated by al-Daraqutni, 1:151, no. 545, and al-Bayhaqi, 1:116. It was declared weak by al-Bayhaqi, Ibn Hajar, and others. See al-Talkhis, no. 158.
