Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

This hadith is authentic and has several corroborating reports. It constitutes affirmative evidence, and the possibility that the kiss was without desire is exceedingly remote.

  1. The basic presumption is that ablution remains valid unless sound, explicit evidence establishes that it has been invalidated.

  2. Purification is established by virtue of legal evidence, and whatever is established by legal evidence cannot be lifted except by legal evidence. There is no evidence for this; this is a negative argument...

They answered the verse by saying that “touching” refers to sexual intercourse, for the following reasons:

  1. This was authentically reported from Ibn Abbas (1), may Allah be pleased with him, for whom the Prophet, peace and blessings be upon him, supplicated that Allah teach him the interpretation (2). He is among those whose statements in exegesis are most deserving of acceptance, unless he is opposed by someone whose view carries greater weight.

  2. The verse itself indicates this, since purification is divided into the original form and its substitute, and into minor and major purification, and the causes of each of the minor

(1) Reported by Abd al-Razzaq in his Tafsir (1/184) and in al-Musannaf, no. 506; and by Ibn Jarir, nos. 9583-9587. Ibn Kathir said: “It has been authentically transmitted through more than one chain from Abdullah ibn Abbas that he said this.” Tafsir Ibn Kathir, on al-Nisa 4:43. This was also the view of Umar ibn al-Khattab. Abd al-Razzaq, no. 512, reported that Umar kissed his wife, Atikah bint Zayd, then proceeded to prayer and prayed without performing wudu. This report was authenticated by Abu Umar ibn Abd al-Barr in al-Istidhkar (1/318), and endorsed by Ibn Kathir in Musnad al-Faruq (1/115). (2) Al-Bukhari narrated it in the Book of Knowledge, chapter: “The Prophet’s saying: ‘O Allah, teach him the Book,’” no. 75, with the wording: “O Allah, teach him the Book.” Ahmad (1/266), al-Tabarani (10/no. 10587), and others narrated it with the wording: “O Allah, grant him understanding of the religion and teach him its interpretation.” See al-Hafiz Ibn Hajar’s discussion in Fath al-Bari, in his commentary on hadith no. 75.
