in that it does not invalidate the ritual or the ihram, and does not require making up the Hajj.
If someone were to ask, “What is the evidence that a camel is required for this?” we would say: The evidence is analogy with intercourse, because it is an act that necessitates ghusl when ejaculation occurs; therefore, like intercourse, it necessitates an expiation. However, there is no explicit text concerning it, nor are there any statements from the Companions.
Yet this analogy is weak. How can a subsidiary case be analogized to a basis from which it differs in most rulings? Intimate physical contact accompanied by ejaculation agrees with intercourse in only one matter: the obligation of ghusl. It does not agree with it regarding the invalidation of the ritual, the obligation to make it up, or the invalidation of the fast—according to some scholars. Thus, it should be said: what is the reason for attaching it to intercourse in this ruling when it differs from it in other rulings? Why not regard it as differing from it in this ruling, just as it differs from it in the other rulings?
The correct view, then, is that intimate physical contact does not require the sacrifice of a camel; rather, it entails the same expiation as the rest of the prohibitions.
His statement, “But he must enter ihram from outside the sacred precinct for the obligatory tawaf”: this appears to be a slip of the pen by the author, may Allah have mercy on him, because this supplementary ruling does not apply to intimate physical contact. Rather, it applies to intercourse after the first release from ihram. Human beings are fallible. Allah, exalted is He, says: “Had it been from anyone other than Allah, they would have found in it many contradictions.” [al-Nisa 4:82]
Accordingly, this phrase would more properly be moved to the discussion of intercourse after the first release from ihram. It is this that the scholars mentioned as invalidating the ihram and requiring a person to leave the sacred precinct, enter ihram from outside it, and then perform tawaf in ihram.
