For example, a man stones the pillars and shaves his head on the Day of Eid, then has intercourse with his wife before performing tawaf and sa‘i. He is sinful, must offer an expiation, and his ihram is invalidated. He must go outside the sacred precinct in order to enter ihram again, then perform tawaf in ihram rather than in his regular clothes, because his ihram has been invalidated.
“Intimate physical contact is prohibited. If one does so and ejaculates, his Hajj is not invalidated, but he must offer a camel; however, he must enter ihram from outside the sacred precinct for the obligatory tawaf.”
His statement, “Intimate physical contact is prohibited. If one does so and ejaculates, his Hajj is not invalidated, but he must offer a camel”: intimate physical contact means contact with women accompanied by desire.
This is the ninth prohibition, and the last of the prohibitions. The evidence is Allah’s saying: “So there is to be no sexual relations, no sinful conduct, and no disputing during Hajj.” [al-Baqarah 2:197] Moreover, if contracting a marriage—which makes such physical contact lawful—is prohibited, then physical contact itself is even more deserving of prohibition.
As for physical contact without desire, such as a man holding his wife’s hand, this is not prohibited. But if the physical contact is accompanied by desire, it is prohibited—whether such contact is with the hand or any other part of the body, and whether it occurs through a barrier or without one—because it detracts from the ritual and may lead to ejaculation.
If this occurs before the first release from ihram and he ejaculates, two consequences follow: sin and an expiation, which is a camel, like the expiation for intercourse. However, neither the ritual nor the ihram is invalidated.
If he engages in physical contact but does not ejaculate, rather emits pre-ejaculatory fluid; or if he experiences desire but emits neither pre-ejaculatory fluid nor semen, then he does not owe a camel. Rather, he must offer the expiation for harm, as we shall mention later, Allah willing.
Thus, intimate physical contact resembles intercourse in that its expiation is a camel, but differs from intercourse
