Al-Sharḥ al-MumtiʿIbn al-'Uthaymin

and in another place, “Allah will shade in His shade a young man who grew up in the obedience of Allah.” He mentioned the seven separately in different places, whereas we have gathered them in one place—can this be called an innovation?

The answer is no. The Messenger ﷺ would also, at times, gather matters together and enumerate them.

Shaving the hair and trimming the nails: whoever shaves or trims three [hairs or nails] must offer a sacrificial compensation, ……..

His statement, “Shaving the hair”: this is the first prohibition. The author did not say, “removing hair,” although that would be more comprehensive, because he followed the wording of the Quran, in which Allah the Exalted says:

“Do not shave your heads until the sacrificial animal has reached its place of sacrifice.” [al-Baqarah 2:196]

Here we should understand that, when we wish to mention something, preserving the wording of the Quran and sunnah takes precedence, because it constitutes both evidence and a legal ruling. Thus, a writer or author should preserve the wording of the Book and the sunnah.

The evidence that shaving the hair is prohibited in the state of ihram is the saying of Allah the Exalted:

“Do not shave your heads until the sacrificial animal has reached its place of sacrifice.” [al-Baqarah 2:196]

There is no doubt that the evidence is narrower than the ruling inferred from it: what is expressly prohibited in the evidence is shaving the head.

Yet the ruling for which this evidence is cited is shaving hair in general, including the pubic hair, moustache, leg hair, and the like. It is not valid to use a more specific proof as evidence for a more general ruling. However, they say: We analogically extend the ruling for shaving the rest of the hair from the hair of the head.

Thus, when we cite the verse, it serves as textual evidence regarding shaving the hair of the head, and as analogical evidence regarding the rest of the hair.

Ibn Hazm and the literalist school said: We do not concede analogy. Allah, Mighty and Majestic, says:

“And We have sent down to you the Book as a clarification of all things.” [al-Nahl 16:89]

He prohibited us only from shaving the hair of the head. So why should we impose restrictions upon Allah’s servants and say: Do not shave any hair at all?
