then no zakah is due on it; but if it is held for trade, then it is subject to trade zakah (1).

If it is said: Is it valid to draw an analogy between permissible jewelry prepared for use and permissible clothing prepared for use, as maintained by those who do not hold zakah to be obligatory on jewelry?

The answer is: Such an analogy is invalid for several reasons:

First, it is an analogy that conflicts with an explicit text, and every analogy that conflicts with an explicit text is invalid (2), because it entails setting aside the text. Moreover, when a text differentiates between two things in their legal ruling, this indicates that there are distinguishing factors between them that prevent one from being assimilated to the other,

(1) We submit to Allah's universal laws, just as we submit to His legislative rulings. When Aisha, may Allah be pleased with her, was asked, “Why does a menstruating woman make up the fasts but not the prayers?” she replied, “This would happen to us, and we were commanded to make up the fasts, but we were not commanded to make up the prayers.” (1) When the Law distinguishes between two things, we have no right to dispute and ask, “Why is it this way in one case and that way in another?” For Allah does whatever He wills in creation and decree, and He legislates and administers as He wills. (2) Usul scholars call this qiyas (analogical reasoning) invalid—that is, legally inadmissible. Every analogy that conflicts with an explicit text is invalid, because it nullifies the text. They have said that the first to employ invalid analogy was Iblis: Allah commanded him to prostrate, but he said, “I am better than him.” His analogy dictated that one who is superior should not prostrate to one beneath him, and that the lesser should prostrate to the greater. It was as though Iblis were saying, “I am more entitled to be prostrated to than to prostrate to him.” Yet this arrogance did him no good.
