And the quorum required for the Friday prayer, but not the permission of the imam. It is recommended to return by a different route …
His statement, “and the quorum for Friday prayer,” means that one of its conditions is also the quorum required for the Friday prayer. According to the well-known position of the madhhab, the quorum for Friday prayer is forty men who are settled residents. We have previously mentioned that the stronger view is that the requisite number for the Friday prayer is three; thus, this ruling is based upon that view. There must therefore be at least three people. If there is only one Muslim man in a village, he does not establish the Eid prayer; and if there are two men, they do not establish the Eid prayer. But if there are three, they establish it.
His statement, “but not the permission of the imam,” means that the imam’s permission is not a condition for establishing the Eid prayer. Thus, if the people of a town have the new moon confirmed and end their fast, they are not required to seek the imam’s permission to establish the Eid prayer—even if the imam says, “Do not establish it.” They must establish it and disobey him, because there is no obedience to a created being in disobedience to the Creator. We previously mentioned regarding the Friday prayer that the imam’s permission should be stipulated when multiple Friday prayers are held. The same applies to Eid: if people need to establish another Eid prayer-ground, they must have the permission of the imam or his deputy, so that disorder does not arise among the people, with each group setting up its own Eid prayer-ground.
His statement, “It is recommended to return by a different route,” means that when one leaves by one route for the Eid prayer, it is recommended that one return by another route, following the example of the Prophet ﷺ: “When he went out on the day of Eid, he would take a different route.” (1)
The wisdom behind this is to follow the Prophet ﷺ. This is the highest wisdom with which a believer can be fully satisfied: to be told, “This is the command of Allah and His Messenger,” and the evidence
