This is correct, because delaying the response does not entail that it is forbidden. But if two people are relieving themselves, each looking at the other’s private parts and conversing, then this is undoubtedly forbidden. Indeed, were it not for the criticism concerning the hadith reported on this matter, its apparent meaning would indicate that it is among the major sins, because the Messenger, peace and blessings be upon him, informed us that if two men do this, Allah detests them for it (1). Detestation is the most intense form of hatred. But if neither of them looks at the other’s private parts, then the very least that can be said is that it is disliked.
Imam Ahmad explicitly stated that speaking while relieving oneself is disliked.
(1) Through Yahya ibn Abi Kathir, from Muhammad ibn Abd al-Rahman, from Jabir ibn Abd Allah: “When two men relieve themselves, each should conceal himself from the other, and they should not converse while doing so, for Allah detests this.”
Ibn al-Qattan said: “It is authentic as a narration of Jabir,” and Ibn Abd al-Hadi endorsed this in al-Muharrar, no. 98.
Al-Tabarani also narrated it in al-Awsat, no. 1286, on the authority of Abu Hurayrah. Al-Haythami said: “Its narrators have been deemed trustworthy.” Majma al-Zawaid, 1:207.
It was also reported by Ahmad, 3:36; Abu Dawud, Book of Purification, chapter: “Returning a Greeting While Urinating,” no. 15; and al-Hakim, 1:157, who graded it authentic, with al-Dhahabi concurring. Al-Nawawi graded it hasan on the authority of Abu Said al-Khudri.
Ibn al-Qattan considered the route of Abu Said weak because of inconsistency and the unknown status of the narrator from Abu Said. Bayan al-Wahm wa al-Iham, nos. 852, 1018, and 2460; see also al-Ilal by al-Daraqutni, 11:296. However, Ibn al-Qattan’s authentication of the route of Jabir has already been mentioned.
